Under the E2 Regulations, a facility storing or using one or more of the 174 listed substances above the specified thresholds, or who has a container with a capacity for that substance in excess of the specified quantity, will have to notify Environment Canada of the place where the substance is held, along with the maximum expected quantity and the size of the largest container for that substance.
If the above criteria are exceeded, the facility must prepare and implement an Environmental Emergency Plan and notify Environment Canada.
Does this Regulation impact your facility?
LEHDER suggests the following steps to determine if your facility is impacted by the E2 Regulations:

Identify if you use any of the 174
specified substances listed in Schedule 1 of the regulation |
| Step 2 |
For each E2 substance used, determine the
maximum quantity of the substance that may be present at your site at
any time in the year. This includes both storage and use. |
| Step 3 |
For each E2 substance used, determine the
maximum capacity of the container(s) in which it is stored. |
| Step 4 |
If EITHER the quantity of the E2
substance(s) OR the maximum capacity of any one of its containers,
determined in Steps 2 and 3, is greater than the threshold, you are
required to submit a notification to Environment Canada. |
| Step 5 |
If BOTH the quantity of the E2 substance(s)
AND the maximum capacity of any one of its containers, determined in
Steps 2 and 3, are greater than the threshold, you are required to:
a)
prepare an E2 plan for each substance that exceeds the threshold and
submit a notification
b) implement the E2 plan, including a test, and submit a notification |
