Reg. 419 – Local Air Quality has introduced changes in the way that
Air Quality is regulated in Ontario that are radical and sweeping. Some of the
elements introduced in Reg. 419 include:
- The contents and format of the Emission Summary and Dispersion Modeling
(ESDM) report are now specified by Reg. 419 with significant changes and
additions from the 1998 guidance document.
- Mandated conservatism in preparing emission estimates. CofA applications
must include an ESDM report for ALL Sources of the contaminant(s) associated
with the specific application.
- The use of USEPA air dispersion models (AERMOD, ISCPrime, SCREEN3) is
phased in over a period of 15 years.
- Three schedules of air standards with variable averaging periods to be
used in conjunction with the staged implementation of the new list of
approved models.
- Targeted sectors (based on NAICS codes) are identified for phased-in
application of the new models and associated effects based standards in 2010
and 2013. All other facilities must demonstrate compliance with new POI
standards by 2010 and the new models and associated effects-based standards
by 2020.
- Specified time frames for facilities unable to meet the scheduled air
standards to apply for Alteration of the applicable air standard(s). The
proponent must provide a detailed report summarizing the potential impacts,
review of available control technologies and an economic analysis. Public
consultation is a required element of the regulation.
